It is a common misconception that workers’ compensation only applies when the employer is at fault. But the fact is, many workplace injuries involve ordinary mistakes.
Some injured workers don’t file for Ohio workers’ compensation benefits because they believe the accident was their fault. However, in Ohio, workers’ compensation is generally considered a no-fault system. That means you may still qualify for benefits – even if you were at fault.
What you need to understand is, no matter what caused the accident, if you are hurt at work, you could be eligible for Ohio workers’ compensation benefits. For example, you may still have a valid claim if you lifted improperly and injured your back; slipped and fell; made a mistake operating equipment or caused a work-related vehicle accident. In Ohio’s system, instead of focusing on fault, successful claims generally center on three questions.
1. Did the injury happen when the worker was employed?
2. Did the injury happen during work-related activities or conditions?
3. Is there evidence (medical and factual) that supports the claim?
This is why it’s important to document everything. Make sure you keep track of medical records, incident reports and witness statements – and report the injury in a timely manner!
While the system in Ohio is generally considered no fault, there are some situations that
could lead to a denial of your claim, including intoxication or drug use; intentionally self- inflicted harm; horseplay or conduct unrelated to work or injuries not connected to employment duties. In some cases, injured workers might delay reporting injuries because they blame themselves. And unfortunately, waiting too long can make it harder to gather evidence and ensure that you get the compensation you deserve.
