Namely, how long does it typically take to settle Ohio Workers’ Compensation claims?

While each case is unique, there are a few common considerations when it comes to talking about a timeline for receiving a settlement.

Here are a few things to know about your Ohio Workers’ Compensation claims.

1. Your case: Your case is your case, meaning you filed it and you do not have to accept the settlement that is initially offered. Understanding that you cannot be forced to accept a settlement that you do not agree with is important, as most settlements consist of a lump sum payment in exchange for foregoing any future benefits. Not everyone wants that! 
2. Timeline of your case: Typically, there is a timeline that occurs when you are injured at work. The first thing you do is report your injury to your employer, and that is submitted to the Ohio Bureau of Workers’ Compensation, where a decision is generally made within a month. That claim can be contested or denied and you may have to have a hearing, where appeals are heard. All of this can take months or even years, depending on your claim and any disputes.
3. There is also a settlement process: While settlement can occur at any time, generally speaking, it is most common to pursue settlement once you complete your medical treatment or your condition is considered to have reached Maximum Medical Improvement.  You can pursue settling the case by filing a form with the Ohio BWC. Then, the BWC will present you a settlement offer – usually within a few months and you can either approve it or not. If you approve it, you’ll get a check within several days. 

In most cases, a process takes 4-6 months. But if you have a more complex case due to serious or permanent injuries or disability, it can take a year or more. 

Additionally, if you have a more complex case, you might be asked to have more medical evaluations performed. And sometimes, larger settlements might require additional review or consideration – adding to the time. 

While there is a lot of waiting to be done, you can take some steps to move your case along, such as:

• Submit your documents early – and make sure they are complete!
• Respond to requests, inquiries and communications promptly!
• Stay in touch with your legal counsel and make sure you are keeping them in the loop about your condition!
